1. Acceptance of Terms
1.1 Welcome to Clink App! By accessing or using our mobile application, you agree to be bound by these Terms of Service (the “Terms”). If you do not agree to these Terms, please do not use the Clink App.
1.2 Clink App is owned and operated by Lumina Solutions Inc, a corporation registered in Delaware, United States.
1.3 We may update these Terms from time to time. We will notify you of any material changes by posting the new Terms on the app or by sending you an email or other notification. Your continued use of Clink App after such changes have been made constitutes your acceptance of the new Terms.
2. Use of Clink App
2.1 Clink App is a social networking platform that allows users to connect, communicate, and share content. You must be at least 18 years old to use the Clink App.
2.2 You agree to use the Clink App in compliance with all applicable laws, rules, and regulations.
3. User Content
3.1 You retain all rights in, and are solely responsible for, the content you post to Clink App.
3.2 By posting content to Clink App, you grant us a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform that content in connection with the provision of Clink App and otherwise in connection with the provision of Clink App and our business.
4. Prohibited Conduct
You agree not to:
4.1 Use Clink App for any unlawful purpose;
4.2 Harass, threaten, or defraud other Clink App users;
4.3 Upload, post, or send any content that is obscene, pornographic, abusive, offensive, profane, or otherwise violates any law or right of any third party;
4.4 Send unsolicited or unauthorized advertising, promotional materials, email, junk mail, spam, chain letters, or pyramid schemes;
4.5 Impersonate another person or access another user’s account without that user’s permission;
4.6 Share Clink App-issued passwords with a third party or encourage another user to do so;
4.7 Misrepresent the source, identity, or content of information transmitted via Clink App.
5. Termination
5.1 We may terminate or suspend your account and bar access to Clink App immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation if you breach the Terms.
6. Disclaimers
6.1 Clink App is provided “as is” and “as available” without any warranties of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
7. Limitation of Liability
7.1 To the fullest extent permitted by applicable law, Lumina Solutions Inc shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use Clink App; (b) any unauthorized access to or use of our servers and/or any personal information stored therein.
8. Governing Law
8.1 These Terms shall be governed and construed in accordance with the laws of Delaware, without regard to its conflict of law provisions.
